June 09, 2010 - Lower Paxton Twp. Police are investigating an incident at the Seravados Italian Restaurant, 4620 Jonestown Rd. that happened yesterday at approximately 3:05 PM.  Police were dispatched to the restaurant for a report of an elderly man who had entered the restaurant and threatened employees with an ASP, an expandable baton.  The man was told to leave and, while exiting the restaurant, had swung the baton and had damaged items inside.  Employees then called 911 and followed the individual out of the restaurant.  When the elderly man went to leave in a vehicle, an employee stood by in the parking lot, in no way blocking his exit, to record the license number.  The elderly man yelled obscenities at the employee and then accelerated the vehicle toward the employee who attempted to flee up the front stairs.  The vehicle struck the employee in the leg pinning him between the vehicle and the stairs.  Fortunately, a metal railing prevented the vehicle from moving forward any more as the driver continued to give the vehicle gas.   The driver then exited the vehicle and yelled at the employee to go into the restaurant before reentering the vehicle and fleeing.  The employee was able to obtain the registration on the vehicle.  The provocation for this incident is unclear at this time but it is known that the man was not a customer of the restaurant.  The victim was treated for injuries to his leg, the extent of which is unknown.

Police obtained a warrant for Nicholas Louis Exar, 82 years of age, charging him with Aggravated Assault and Disorderly Conduct.  He was arrested this morning without incident at his home in the 4100 block of McIntosh Rd.  He is awaiting his preliminary arraignment.
